Terms of Service & Medical Disclaimer

1. Acceptance of Terms

By accessing or using the BellaNue AI Skin Concierge application, website, and related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Eligibility

You must be at least 18 years of age, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement. If you are using the Service on behalf of a minor, you accept these Terms on their behalf and assume full responsibility.

3. Account Registration

To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service in any way that violates applicable local, national, or international law or regulation.
• Upload or transmit content that is defamatory, obscene, fraudulent, or otherwise objectionable.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems connected to the Service.
• Use the Service to collect or harvest personal information of other users without their consent.
• Reverse-engineer, decompile, or disassemble any aspect of the Service or its underlying AI technology.

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, AI models, and software — are the exclusive property of BellaNue or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

6. User Content

By uploading photos, text, or other content to the Service, you grant BellaNue a non-exclusive, worldwide, royalty-free license to use, process, and analyze such content solely for the purpose of providing and improving the Service. You retain ownership of your content and may request its deletion at any time in accordance with our Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by applicable law, BellaNue and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. In no event shall our total liability exceed the amount you have paid to BellaNue in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless BellaNue and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Metro Manila, Philippines.
